  • Any problems in my 485?

    Hi all,

    I filed my 485 application at VSC on December 19th and ut was received on December 20, 2001. I have an EAD and as you would notice, 180 days have passed since the receipt of application. My company is downsizing and I may be fired. My questions are:

    1. If I have to move to another company, should I get a letter from current employer that it is ok?
    2. If I do not get a job, what happens?
    3. If I can just get an offer letter from a new company is it ok or should I show paystubs if called for interview/during stamping?
    4. In the 485 filing, I have included my tax filings. In one of the years, my salary is significantly lower than the norms(almost 30% lower). Will it affect my GC?

    485

    1) you don't need a letter from your previous employer to change the employer.

    2) You SHOULD have a job at the time of 485 approval. If you get an RFE, you should be able to present a letter.

    3) In the RFE, you might also be asked for the paystubs. If you are lucky, you will not get an RFE and no need for the paystub, but it is not certain. So, best thing is try searching for a new job if you think the layoff is coming.

    4) If they notice that and if it was for the recent year, you will get an RFE for the tax returns for the latest years. This shouldn't matter much as 485 is for a future job, and the tax returns are mainly for the support to your spouse. However, INS works in a strange way, so never assume anything.

        Lawyer's Help

        If I moved on to a different employer after the 180 days of filing I-485. How would I know of any issuance RFE ?
        Since the lawyer would be employed by the previous employer. What am I supposed to do regarding getting acknowledged of an RFE.
