  • Court Wedding

    Hi,
To get our paperwork moving quicker, my fiance (L1Bholder) and I (USC) had a small court wedding done here in the US. We'll be having a large ceremony and reception later this year in India, where our families live. This is an arranged marriage. I'm a college student, and he's working for an employer in another state, so we are not living together. (He can't switch jobs b/c of his visa type, andthe college near his place that has my major does not accept transfers until the 3rd year of the program I'm persuing.) He comes to visit often, and we've travelled together, and have extensive phone conversations and chats.

My question is about the interview. Surely our one witness quickie wedding, and living apart will come up; and I feel like the odds are stacked againsted us. I'm wondering if mentioning that we'll be having another ceremony with more guests at a later date is a no-no or not.

Unless the "formal wedding" happens before the interview (she can use her L1 visa to travel and return without abandoning the AOS process). You will have to prove A LOT of things to the Immigration Officer that interviews you, bring as much evidence of joint life as possible and yes, it will be tough.

At what point do you two intend to start living together? that is also VERY important. Having plans for the future and such.

Why not file for EAD? with that she can work anywhere she wants to... and do not forget the AP.

As for the EAD, I am actively persuing the option to transfer colleges, but I still need to wait before I can apply to the program. We thought there would be no point in processing an EAD b/c he does not want to change jobs and when we filed before the rate hike, so we decided not to spend the extra money.

As for the AP; he doesn't need one because he can travel on his L1B visa type. Our "formal wedding" will not take place before my interview, so its best not to mention it?

You can mention the plans for it, but certainly your legally binding court wedding is the beginning of your marriage and the date set on the immigration process.
