  • Initial Interview for Adjustment of Status

    First of all, thank you in advance to anyone who may respond to my thread.

    I married my husband (who's a US Citizen) in Sept 06 - but without a fiance visa. I know, we should have applied for me to stay that way, but neither of us was sure we would have wanted to get married once I was here; nor did we have much knowledge of the immigration rules and paid the price:

    I applied for my adjustment of status before my I-94 card expired, and also applied for a work permit. My first work permit was rejected because I didn't put down the right 'adjustment of status' code, and also, the INS lost my first I-485 application (thank God I kept the money orders' receipts!!!). Now, we've been called for an 'initial interview' for the adjustment of status and don't know what to expect, will they interview us for marriage fraud? or will they give us a fine for not applying for a fiance visa? or will they issue restrictions on the GC permit (if they give me one!).

    I'm wondering if anyone else went through a very similar experience.....or anyone else out there who may be able to give some advice? Thank you

    There are no restrictions on the card, there will be a condition (if you have been married less than 2 years at the date of approval). Read I-751 for that.

    As far as the interview, this is the first and normal interview everyone gets... not necessarily to see if you are a fraud, but to see if you are a real couple.

          probably some kind of non-immigrant visa.

          visitor or student most likely.

            Yes, I came with a visitor's visa and I have an Italian passport. The good news is that my interview with the immigration officer went very well, and have been granted a green card!
