Great forum - I have been following it for a while and got a lot of questions answered by reading through the threats. Now I need to post one myself and I could urgently need some help . . .
I am currently here on an L1. Earlier this year I have started the GC process. The I-130 got approved with no problem. I have then filed I-485 with all the supporting documents for AOS. The recently received the Appointment Notice for biometric service. At the same time the USCIS has come back with "Request for initial evidence" with:
"the petitioner/sponsor must submit all supporting tax documentation (W-2s,ect) submitted to the IRS for the most recent tax year"
My wife (US Citizen) as the sponsor/petitioner is a stay home mom and thus has no individual income. We have filed our tax return 2005 and 2006 jointly.
Since we file jointly my wife has no seperate tax documentation.
In the I-864 we have given her income as zero and all income is from me (the intending immigrant). My income is high enough. We have provided last year's W2 and a letter from the employer confirming "continuity of employment / income from same source after obtaining..."
What is the background here?
Is it not possible, that the intending immigrant is the only provider of income?
What should we do now?
