  • AOS with a misdemeanor crime in past.

    Does any one have experience or know anything about filing for AOS in case one has criminal history for a misdemeanor like shop lifting ?.
    Do you have to mention this on I-485 form ? If you do, is there any chance of getting approved ?
    Does any one has any experience on such case ?

    Were you finger printed, went to a court?

    In this case, it is better to mention on the 485 application.

      I was fingerprinted for an arrest (not convincted though) for a misdemeanor (of moral turpitude) sometime after the labor certification was done but before submission of the 485. I clearly listed out all details (alongwith certified court copies as suggested by my attorney) of the arrest in the 485 app. About 5 months ago, my case was transferred to the local INS office and the AVM out there suggests that I will be notified for an interview.

      The questions I have are - what are my chances of being rejected for the GC? Has anybody else out here been through this? What should I expect to be asked at the interview?

        misdemeanor should not become a basis for the denial. Since you have informed INS, they want to make sure that the things are as stated by you. Take the same court order copies with you jsut in case. Also, if possible, try to get one-two letters of good conduct from somebody whom you know and is having some honorable position in the society or may be from a co.'s high officer (like director). you shouldn't have any problem if all the rest - job letter, paystubs, tax returns etc. are ok.
