  • Need help to file i-485...PLEASE

    Hi there. I hope someone can help

    Ive searched and searched for help online but cannot find anything i can go by.

    I entered US as a visitor to see my fiance....we got married 3rd december and im trying to ajust status from visitor to Spouse and also get a work permit too.

    Does anyone know what we need to file. I know we need to file I-485 and work permit form, what else do i need to send? Does anyone know how much i would pay. I have checked but need someone to confirm...we dont have a lawyer.


    And do i send everything in the same envelope to the same place?

    Please help if you know anything...its all legit and real so no worries there.

    Be advised, that you may be accused of misrepresentation at the Port of Entry and immigration fraud, by using a visitor visa, to enter and marry, and apply for Adjustment of Status.

    When did you enter the USA? What date?

      Yes thank you. But like i said in my post...its all legit etc..i understand there is a chance of being accused, but im not too worried about that as it was all spur of the moment...i had a job and family in uk..so it wasnt planned to just marry!

      I am on here for advice on how to file my form...which forms etc, please can someone help

        Also, answer the question, on what date did you enter the USA? I may be able to provide further advice if you actually follow it.

          Hi. Thanks i have seen the link before.....I have read up o every page possible about this subject. but need help from someone who knows. I entered on the 29th November and my visa expires end of feb..and i know how many days before i need to file.

          Do you or anyone know exactly what forms (if there are anymore other than i stated) and how much it would cost..i just dont want to make a mistake....from what i see it will be $1360 all together (adjustment and work permit form)

          Im sure you understand im a little scared and desperate to just get this sent off

            You my friend, are in trouble.

            You entered the USA on November 29th and got married in December 3rd. That can not be said that was "spontaneous and unexpected" and USCIS will most definitely question your statement at the port of entry when you said "I am coming for a short visit and going back home in X months".

            You can not use a non-immigrant visa (visitor visa) with immigration intent (getting married to an US Citizen and applying for Adjustment of Status).

            Proving that you did not misrepresent yourself and lied to the POE officer will be VERY hard and the burden is on you. You should have applied for a K-1 fiancee visa, if your objective was to marry and file for AOS.

            There is a "rule of thumb" called the "30-60-90 rule" and it states:

            Suppose someone enters on a B-2 visa and after "x" days applies for AOS either through marriage, or any other family sponsorship.

            If x < 30 = USCIS will accuse the applicant of committing fraud/misrepresentation and the burden of proof lies on the applicant
            If 30 < x < 60 = USCIS may accuse the applicant of committing fraud/misrepresentation and the burden of proof lies with the applicant
            If 60 < x < 90 = USCIS may accuse the applicant of committing fraud/misrepresentation but the burden of proof will lie with USCIS
            If x > 90 = USCIS will most likely not accuse the applicant of committing fraud/misrepresentation

            You, got married in less than 1 week and will apply for AOS as result of that marriage, that makes you a target for them.

            The best advice I can give you is DO NOT file for AOS. Go back to your country and have your wife apply for a K-3 visa for you (which you should receive in 5-10 months) and you can come to the USA and AOS.

            Otherwise, you have a very nasty uphill road... because there is nothing to save you here... if you had married maybe 2 months after entering or so... maybe, but not just a few days...

              wow, really?

              I came for a quick visit....and two days before i was meant to leave we just decided to get married! And i called my family and told them i wont be coming back.

              Im surprised at this. But i guess thats how it goes. I mean i have the truth and god on my side, so ill go ahead.

              Can anyone help with what forms etc to send

                  me and my hubby didnt even have the money to send these forms, we are tryin to save up to send in good time.

                  Does anyone know any good attorneys to help us? And how much does an attorney usually charge for this service?
