  • I-485 & I-765 & I-130

    I am a USC. Married my Pakistani Citizen husband who was here on a B2. We got married in June and filed everything end of July. We recieved our receipt's and later a letter for fingerprinting. We complete the fingerprinting Oct 27th and still have no response.

    The receipts do not have a priority date on them.

    His I-94 expired Aug 8th and Immigration detained him Dec 18th from our home. We are waiting for our bond hearing on Wed 26th December. I am not exactly sure what we did wrong.

    He has no criminal records or has ever stayed in entry in the US.

    Any idea's/Suggestions?

    Did you show them the receipt for the I-485? who detained him and why?

    You need to seek a lawyer right now. His legal status is not "Expired" since he is undergoing Adjustment of Status.

    He being a pakistani citizen though, makes things harder, they probably were more concerned because he never left the USA and entered on a non-immigrant visa.

      Yes, but he came here with a VALID 5 yr multiple entry visa. We filed everything in TIME before his I-94 expired. They say that he should have filed for an extension, we told them that YOU CANT file for an extension if you have filed I-485. They said regardless his was not approved NOR DENIED so he is considered to be here illegally.

      Immigration & Customs picked him up. I did get a lawyer, he has filed a motion of Bond and waiting for hearing on Wed.

        You have a case against ICE here... he is NOT consider illegal. He is considered "pending AOS".

          Yea but who listens? They keep saying until his case is approved he is considered illegal.

          I have contacted everyone i can, from ice, to congressman to deportation officer, no one can do anything. we are just waiting now for the hearing. Not sure what's going to happen.

          I called USCIS to get case status and there was no PRIORITY DATE on our reciept, the lady on the phone said there wasn't one assigned. Does that mean anything?

          I have learned of another guy in detention who was here on a student visa, took one semester off (has a written letter) as his wife is due in 2 weeks. they took him in.

          I am not sure what they are doing...

            Hearing

            It only gets better. FInally Wednesday comes, we wait at the court for our hearing... 2 hours later we are told my husbands files not there so its postponed till tomorrow w/out guaranty that his file will be there tomorrow. What do you do?
