  • Fraud interview - What happens if you fail?

    The title pretty much says it all. I want to know what happens if you are to be deported (like.. is there a 30 day wait or is it immediate? Does the US government pay for your transportation, etc)

    I guess that there are different procedures for different situations, so here is my situation: I entered legally under the visa waiver program. About 2 months after my vwp expired, I married a US citizen and this is the basis for my AOS. (I am from the UK, caucasian; I don't know if this makes a difference or not)

    There is no reason why I SHOULD fail the interview as my marriage is not fraudulent but it could happen and I am sure there are reasons that they might deport me other than a suspected fraudulent marriage. I would like to know what to expect should the worst arise.

    Thanks in advance to anyone who helps. If you need further information on my situation I can provide specific details.

    .... Does nobody know? My interview is in a few days, I'd really like an answer, I can't find out anywhere...

      How many days you are out of status before filing your I 130/485 exactly.
