    Hello,

    I filed my I-140 though national interest waiver (NIW) category. I-140 was approved in late May. I am currently in the process of adjustment of status. This week we were informed by the employer that my site will be closed due to the declining market. We are expecting to be out of job within 2-3 months. I wonder how much this will affect my I-485 process.

    Here is my situation:
    filed I-140 through NIW (not employment based)
    I-485 priority date 6/28/02.
    Already obtained my EAD.
    FP scheduled 8/22/02.
    INS Vermont Service center.
    Expect to lose/change job by the end of November.

    My specific questions are:
    1. Do I need to re-file anything if I change my job?
    2. Is there any geographical restriction if I change my job?
    3. What could possibly happen if I am called for interview when I am still looking for job?

    NIW

    Since NIW is not employer based, you should not have a major problem. The job in hand is always a safety, but unlike other EB / LC based categories, your 485 can not be denied solely on the ground that you are laid off. Also, it seesm that you have ample time before there is any RFE or Interview. In the meantime, you can definitely find a new job.
