I have an H1-B visa since Nov-2002. My second H1-B extension petition was ended on Nov-07.
I left US in August-06
I have an approved I-140 and has not filed I-485 yet because of priority dates being unavailable.
I have been out of US since August-06. and want to file my 2007 taxes.
My tax accountant told me that since I was out of US for the full 2007 year so I have to change my status with IRS to "Expatriate Non-Resident Alien". This way any tax deducted by my employer in 2007 will be reimbursed.
My question is this that will the status change have any impact on my green card (I-485) process?
