  • Coupla questions about interview

    My wife (Indian) and I (US) filed for the 130 131 485 & 765 recently. Got really quick responses, and already have the EAD and AP. Have the 485 interview scheduled for after a few weeks. Had a few questions about that:

    1. What happens after the interview? Is it ok to book tickets for the evening of the interview to leave the country for a weeks? What would my wife be travelling on? The AP or the stamp on her passport after the interview?

    2. She filed for AOS on her 5th month on B2 and by now its expired (the 6 month allowance expired, not the visa on a whole, that has 9 more years). Will that be an issue while leaving or coming back?

    3. What do we take to the interview? Most of the documents they ask for on the interview document has already been submitted, all I can think of is wedding pictures and a few random ones with family. Anything else?

If she is approved, she can not travel on AP, she must wait until she receives her Permanent Resident Card (unless she gets the I-551 stamp on her passport, but they hardly ever do that anymore). If she is pending FBI namecheck, she can travel on AP.

    2. She filed for AOS on her 5th month on B2 and by now its expired (the 6 month allowance expired, not the visa on a whole, that has 9 more years). Will that be an issue while leaving or coming back? No, as soon as she filed for AOS (i-485) she was in "AOS pending" status. But she can no longer re-use that visa... it will not cause any problems though.

    3. What do we take to the interview? Most of the documents they ask for on the interview document has already been submitted, all I can think of is wedding pictures and a few random ones with family. Anything else? The interview appointment letter tells you what to bring. Also you must bring the ORIGINALS of EVERY document you sent to USCIS... Along with things that prove that you two live together and have a bona fide marriage.

      That was fast, thanks alot.
      Unfortunately the 1st answer was depressing. We had to reach India on the day after the interview, and we had tickets to leave US in a weeks time, which were postponed when the interview notice came. Were hoping to leave the day of the interview, but not anymore I guess.

      So just so that I got it right, if the interview goes well and the name check is done, then we won't be able to leave the country, correct?
      If thats the case, then how long does it take to get the PR Card?
      Also, is there anyway to request or file for the i-551 stamp on the same day? (Guess not based on what you said, but worth a try )

        It is possible to request the stamp on that day. Bring the plane tickets, you may or may not get it.
