  • Facing deportation- PLEASE HELP!

    HI,
    My best friend is in a most horrify situation any man can ever face. Let me start from the beginning.
    My friend got a greencard 30 years ago, when he was 18, he was ignorance, his parent passed away when he was born and he stayed with his relative. He commit a crime before ( murder) and was served 15 years in prison. He served all of this sentence and ready to move on to be a better person. On the day he was supposed to be release, the immigration held him back and put him in prison waiting for deportation to Vietnam. You can't imagine how it feel after serving 15 years in prison and waiting for the day of freedom suddenly you are facing deportation to a country that you have no memory of. His relative ran for help. Finally, they found a lawyer to help him get out. At that time, Vietnam didn't accept and of its citizen who are being deported from a different country. So because Vietnam didn't accept him, they have to release him. He after that moved on and live a good life. He worked hard, very hard, he want to turn his life around. He married, have 2 new borned sons, brought the house, the car and glad that he can turned his life over. Even though his greencard was taken back, he can get the working permit to pay his taxes and everything else. Every month, he have to go to see the parole board and call in to make sure he's in the state. But it's OK because he's a good citizen now.
    A month ago, Vietnam signed a historical agreement to agree to take back the citizen who are being deport. He didn't know anything about it until his old friend called-who also have the similar situation like him- saying that he received the letter from the government telling him to surrender within 15 day s to be deport back to Vietnam. He was panic. Making the matter worse, now when he called in to report, he was told that he no longer need to call that they require him to come to see the supervisor. He is scared. He doesn't know what to do, he doesn't want to show up and being held by the immigration. He have a wife and 2 new born sons with no relatives in Viet Nam.
    He want to know what's his chance to stay in US and what can he do ???????????? Please help................

    Get a good immigration lawyer. But from the immigration stand point, he committed an offense that makes him inadmissible in the USA. Probably banned for life.

    Maybe an I-601 waiver would help him... but I doubt it. get a lawyer.

      If he had given the person he killed a second chance, he would not be in this bind. That's said, I have heard of someone facing deportation for shooting A gun in the air, which is less than murder, but still a crime. He needs to hire a lawyer asap, that is the only option I can see.
