  • I-485, EAD and H1B

    I have applied for AOS (I-485) and I am on H1B at this time. In case my I-485 is denied, do I have to apply for new H1-B, or can I continue my job with the existing H1-B, even though my AOS request has been denied.

    I read somewhere, if I switch from H1B to EAD, and I-485 is denied, then I have to obtain new H1B.

    At this time, I am just trying to evaluate the pros and cons for EAD/AP, and if I should use it or not?

    I do not have H1B visa stamped on my passport and I will have to go to my home country to get one. Incase if H1B visa is refused at a US consulate in my home country, will I be able to come back to US on AP/EAD?

    H-1 ok

    your H-1 is ok to use for work unless you are traveling abroad for some other reason than just getting a stamp.

    If H-1 denied, it will be recorded, and you might have trouble using AP.
