  • After AOS INTERVIEW

My US Citizen husband and I went to AOS interview on 1/31/2008.

We answered all the questions truthfully but the DAO wasn't really happy about us whenever one of us murmured for the questions that need sometime to think. For example of a question " What was her status when you first met your wife?", he don't know the term "H1B VISA" but, he answered that I was a student and in US with student VISA. The DAO asked my husband to find my birth certificate from the binder that I brought(and mainly organized by me) but, he had hard time to find it because it was written in foreign language. So, I helped him to pick it up. The DAO doubted about the originality of my birthcertificate (It was the original !) and said it required to be checked.

After 45 minutes long interview, the DAO said that they will review the case and will send a decision by mail in couple of weeks. The DAO actually said " If the case approved, you will get a Greencard, otherwise you will get denial notice with the reasons.". The DAO also wrote "A/# YYYY YYYY , I-485 pending, YYYY XX DAO, 1/31/2008" on my passport and I wonder if this means we may need to do the 2nd interview ?? Is this possible to be denied for the bona-fide couple ?

As much as I want to settle this down as soon as possible, I am very anxious about the decision.

It can be denied, or called for a 2nd interview. You should have prepared your husband better.

      What can we do if...

the case is denied without asking the 2nd interview ??
Do we have to file again ?

Yes, either that or file a motion to reopen. But filing again is easier...
