  • Is this an appropriate time for AOS??

    Hi!
I'm a new member in this forum!
I've found this forum really helpful and interesting. Thanks everybody who help the others in this forum.

I've applied for green card through a family member (my mother) about 8 years ago .Then I entered US with H1B 100 days ago (3.5 months). Now my visa number is current.Do you think is this a proper time for me to perform adjustment of status or is it early? and if I adjust now and quit my current job , is there any possibility of adjustment of status rejection in the interview time?
Actually I'm in a situation that I can't go back to my home country , so I want to be assured that the adjustment of status won't be rejected at interview time.Thank you very much for your response and your suggestions.

    Regards

File for AOS but don't quit your job until you get your GC.

It seems this is family based AOS. Then why to continue same job until GC is received? You can move to new job with H1 transfer.

Second I think in H1-b visa if you have mentioned that you have pending family based immigration application then there should not be any problem in interview.

If he quits his job he will be out of status. And that is only forgiven for Immediate Relatives of US Citizens.

A married/unmarried son OVER 21 is NOT an immediate relative, so if he falls out of status, he will not be able to file for Adjustment of Status in the USA.

It is in his BEST interest that he remains working for his H1B employer, that way he will have a safety net to fall back to in the very UNLIKELY event that his AOS is denied, and he can travel in and out of the USA with his H1 visa.
