  • Advance parole expired. Need to travel in 2 weeks.

    My H1 B is expiring on March 1st 2008. Advance parole expired on Feb 18th 2008. EAD is expiring on March 27 2008.I-485 is pending since Feb 5th 2007.
    I need to travel to india in the first week of march, what are my options?
    File for renewal of advance parole? How long? Can I expedite?
    File for renewal of H1B ? How long? Can I premium process?
    Very anxiously awaiting your reply.

    You are not going to get anything done in 2 weeks... you should have planned this ahead of time. It would take at least 3 months to get an AP approved.

      Thank you for your reply. I was, however, not planning a trip anytime soon to India, but need to now, to help my mother, who lives alone, with a family matter that has come up.
      My friend got his H1-B visa renewal in a week, thats why I was hoping it is a possibility that would work for me.

        What you can do is.
        Go to your local USCIS office, book an infopass and explain your situation.
        Tell them you have an emergency situation back home and need to get home.
        Bring any supporting documents that prove that it is an emergency reason.
        Often if USCIS determines it is an emergency .. they will grand you a travel document on the spot.

        Although the chances are very slim, you have nothing to lose by taking this route.

          I just wanted to update you all that I went to my local office, took a doctor's note stating that my mother, who lives alone, has developed pneumonia and needs full time care for at least 3-4 weeks. The immigration officer made me wait 2 hours only to tell me that it is not a 'life and death' situation and therefore she cannot expedite my application for advance parole. I am considering abandoning my 1-485 application which has, by the way, been pending for more than a year now, and just leaving the country to take care of my mum.
