  • Confused with I-130 and I-485

    I am a USC,my wife is Russian. She is on a visitors visa. What form do I need to send in to change her staus? So she is legal to stay here.

        Thank you for the link giving me the information I needed. However, is it possible to file the I-130 first, then the I-485 at a later date?
        The reason being, we lived overseas for 4 years and my taxes are complicated and will take a couple of more months to be accepted by IRS.So I cannot file an affidavit of support at this moment. Your assistance and advice is greatly appreciated.

          Filing an I-130 alone will NOT give her any kind of legal status.

            Just to make sure this senile old man has it right, I file the I-130 and the I-485 together, does that adjust her staus or must the affidavit of support need to be filed also at the same time?

              I-130, I-485, I-864, I-693, G-325A. Are the forms that MUST be filed for an Adjusment of Status.

                  You can also include I-131 (travel permit) and I-765 (work permit). The fee for those is included in the I-485 fee.
