  • risks to wife's family?

    Hi everyone,

My wife and I are applying for AOS for her (I'm a USC, she's here legally on a student visa). We've read about the importance of always telling the truth and so we're telling everything like it is... our one worry is that her family is here without papers. On the biographic info page it asks to list their place of residence. We are putting their US address. Will this put them at risk or scrutiny by the USCIS/INS?

Any comments, experiences or thoughts would be greatly appreciated.

    Yes.

How is she here legally and her family isn't?

She has an aunt who's lived here for 20+ years and is a greencard holder. She came to spend a few months with her aunt, practice english etc. Ended up enrolling in school and received a student visa. Circumstances in her home country worsened and her parents came here separately and without papers a couple years later.

Sooo, you're saying filing our application as we should is likely to put her family at risk. That's very bad.

We realize that any false statements would be very bad as well. Any thoughts? Suggestions? Percentage chance that her parents will have problems?

Thanks so much for your help.

She must put all of the information truthfully.

Her parents have been here several years and ICE has not caught up with them... however, there is no way of knowing if they will find them and deport them... she will have to live with that uncertainty, there is no way around it.

Also, I can not be too concerned, what her parents are doing is illegal.

Submitting false info is not and would not be a possibility for both the practical risks and moral problems.

We really appreciate your advice and understand your not being too concerned as they are here illegally. To us, though, they are family and while we'd love for things to be otherwise, we must deal with things as they are.

If anyone else has had a similar situation with positive or negative outcomes, please let us know either be post or PM.

          Thanks....

            hey

a friend of mine came here when he was under 18 with his parents. his mom was on a R-1 visa and the rest of the family were here on a R-2. His mom got cancer and past away about a year and a half ago and wile he was able to change his legality here trough his usc wife, his father stayed here and he is now ilegal. when he whent for the interview the officer asked him about the location of his father and he responded that he doesn't know and if he has more questions about his father then he can contact his lawyer and that was it. I would sujest for you to put there that you don't know their location, that way you don't put anyone in risk.
            good luck

Anyone else have experiences with friends or family who have had a similar situation? We're trying to assess the risk that could come with filing this application truthfully.... please help us know what you've experienced....

From my personal look at things. I see Illegally present immigrants roam the streets of the city where I live. And most of them will never be deported... only people who "get in trouble" are usually deported.

But, I have also heard of ICE knocking on people's door and put people on removal proceedings...

The thing is, that there is NO WAY of really knowing...

Are the parents employed? if so, do they pay taxes?
