  • Green Card Process - Laid-off

    Please help,

    I was past my 180 days (Receipt of I-485), when I was laid-off from my company that applied for my green card. I have an EAD card, but I have not been able to find another job similar to previous job. It's been 2 months since I've been unemployed. I've decided to look for a job similar to the one I had previously, therefore I did not just go out & start working on any job that I could find currently with my EAD card. My biggest concern is what happens if I get called for an interview or "Request for Evidence" at this time while being unemployed. I've kept track of all the jobs that I applied & the 2 openings that I was called in for an interview. I'm not sure if this is enough for USCIS to show that I'm seriously looking for another job. Is there any other option for me? PLEASE HELP. I've spent a lot of money & started my life here in the US. Losing my green card at this moment, would be devastating. I've been here over 12 years now, this is my home.

    It would be a difficult situation if you get RFE while you are unemployed. It really depends upon who USCIS reacts to that.

      Many good companies ...

      ... agree to continue the GC process even if they let people go.

      Most "compassionate" employers know that the employment based GC process is lengthy and expensive and work with the laid off employees to continue the green card process till the end.

      This means that even in case of a RFE they respond back to USCIS.

      The GC process clearly indicates that the company has an opening for this prospective employee for a particular position. There is no compulsion for the company to have the said employee currently working for them. I've personally seen this work quite a few times.

      However, it would be in your best interests to get a job in the same filed with any other employer, pronto! Even if you take a salary hit, it would still turn out to be good for you in the long run.
