  • i-485 application package

    hi all,
This is my dilema. I went to a lawyer in new jersey in february 08 to have him file my adjustment package. I submitted every document including my medical exam! This lawyer told me that i still have to pay the 340 for my EAD even though the website says its free. He submitted the check of 340 to uscis! , I asked that all copies of what he is about to file be sent to me since he would,t give them to me . A week later he sent me copies of the paper work, first of all the cover letter said vermont service center( shouln't it be sent to the chicago lockbox since i'm in nj?)he listed as paperwork filed only my i-130,i-485,i-765. No medical exam,No i-864 or my daughter,s birth certificate.when i contacted his secretary with the necessary corrections she was very rude and told me the lawyer was annoyed because he feels like i'm telling him how to do his job.Is it just me or does this guy not seem to know what the hell he is doing? how is this going to affect my case? will there be a delay?

Yes, there will be plenty of delays.

    1) It must be sent to Chicago Lockbox.
    2) No check for EAD needed anymore.
    3) You must submit all initial evidence (including birth certificates and medical exam).

Fire this lawyer, get your money back and take control of your immigration process.

First of all Iam no expert but I do know for a fact that you dont pay for the EAD. And the lawyer should not get annoyed, remember he is working for you and should give you copies of everything, personally if you have a straight forward case I recomend doing things yourself. I hate bad lawyers
But anyway Here is what you pay:
      I-130 $355
      g325a free
      I-485 $1,010
      I-693 free
      I-864 free
      I-765 free

Also here was my checklist I-485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

      Cover Letter
$1,010 money order for Form I-485 and biometric services payable to the Department of Homeland Security
Form I-485: Application to Register Permanent Residence or Adjust Status
      Copies of the immigrant’s passports
      Copy of visa-entry stamp
Copy of I-94 (front and back)
Copy of the immigrant’s birth certificate
Certified copy of certified marriage certificate
Form G-325A filled out by the immigrant, signed and dated
Two passport-type color photos of the immigrant
Form I-693 Medical Examination for intending immigrant
      Form I-864 Affidavit of Support
Copy of the U.S. Citizen’s birth certificate (front and back)
Copies of Federal individual income tax return for 2006.
W-2 Wage and Tax statements for years 2004, 2005, 2006.

      3. I-765 Package
      Cover Letter
Form I-765: Application for Employment Authorization
Copy of I-94 (front and back)
Two passport-type color photo of the immigrant

Hope this helps!! also if you need a check list for the I-130 let me know!

        shady lawyer!

Thanks alot guys! my gut instint was telling me all along that this lawyer does not know what he is doing! Now my question is, where do i go from here? should i refile on my own? or should i juist wait? do i have a legal right to ask for my money back since he already submitted the paper work? should i wait to see what uscis is going to say? do you think i should post his name here so that other people don't fall in the same trap! will uscis reject my case or refund my 340 for the ead card! Oh by the way i paid him $1000 wish he went to my bank and cashed the next day!!!

I think you should demand for your money back, and if he refuses file a complaint to the bar association. There is also a papper that you file when you fire your lawyer; and when you fire your lawyer by law he has to give you everything in your file. And if he still refuses write a formal letter to him (or even email ) and keep it in your file.
Now as far as weather you should refile? I dont know hopefully praetorian can help with that.Again I am not an expert in law but my husband is a federal officer so I know the basics. I truly wish you the best!
Also I dont recommend you post his name, it can make a messy situation even messier, but you can pm the name to people.
