  • Working while Adjusting Status

My fiancee has overstayed a work visa, and continues to work at his same employer as he has for the past 6 years. We are getting married in June and will file for his adjustment of status immediatley. While his adjustment of status is pending, will he be able to continue working at this same employer? He has a valid social security number, is a homeowner, and has paid all taxes even while out of status. It would be ideal if he will not be issued an all new SSN as that will screw up our credit history for buying a home, etc.

    Any insight into this situation??

He will not be issued a new SSN. That will never change.

He should however, stop working illegally, even though it will be forgiven because of marriage to an US Citizen. He should admit it (that he worked illegally) if asked, but he should stop at least until he receives an EAD (employment authorization document).
