    Im a greencard holder... I went back to my homeland and got married. Im in US now again and my wife was left in the Philippines. It will take years for my wife to get here in US through family based petition. NOw my wife is here in US via Visitors Visa. If she will not comeback to Phils. anymore, could I file a petition for her and get an adjustment of status? Will she get deported? PLs help...

    If you are not an US citizen, I don't think she can overstayed, she will be illegal.

      You can not file any petition for her that will give her immediate legal status. You can only file i-130 and it will take 5-6 years for her to be able to adjust her status.

      She should not violate the terms of her visitor visa. This will constitute fraud and she could be deported and banned for life from the USA.

      You knew that it would take 5-6 years when you married her. Do not try to be above the law now. You must face the consequences.

      How far are you from becoming a citizen?

            The only thing she can do is apply for an F1 visa or an H1 visa and maintain status for the next 5 years. When you become a citizen, she can apply for AOS or get Green Card through consular processing in her country (usually both within 6-12 months).
