I am married to an American. We met in Iraq, went to the Philippines to get married and came to the US so he could start setting up the place for us to stay and to look for a job. Since I have an existing B1/B2 visa, I was able to travel to the U.S. with him. I was 8 months pregnant at that time. I gave birth here. My husband started all the immigration paper works while I am here with him. We decided to file an extension so I could stay longer until we get a word regarding my K3 application. When we received interview schedule which was to be held in the Philippines, I was in Panic bec. my I-94 was not back yet, we submitted it along with my extension application. Then a friend of mine who is working in a law firm told me that I do not need to go home to the Philippines, I called USCIS to verify this and yes they did confirm that I do not have to go home. With that information, we did everything here in the U.S., fingerprints and etc... Everything went smoothly, my petition was approved, I was able to get my Work Authorization card, my advance parole and I received my SSN card. I thought everything was going well until we had our interview last Friday (03-14-08). The officer was asking how we got into the United States with my visit VISA, she wanted to know what we told the immigration officer. We told her what we could remember since it was a while back. I remember telling the immigration officer at the airport "I'm with my husband" nodding to my husband who was standing right next to me, when he asked what was the purpose of my visit to the U.S. He took all the papers (passports, visa and marriage contract), looked at it and he asked how long do I want to stay here and my husband answered "For however long you can give her". Honestly, we did not even know that I am not suppose to be here. I just happen to have a B1/B2 visa so we used it. We just wanted to be together. The officer said she somehow does not believe our story, that I should've been turned back or sent back to the Philippines. The officer was having a difficulty believing our story but it was the honest truth.
We tried to follow the instructions in the forms and we've read a lot on the USCIS website to make sure we are doing the right thing as we have no lawyer. I didn't know about this site before. I found it via google when I was trying to find more info about our case.
The Officer said she will look into it further, investigate further and we will get the result in 2 to 3 months. I haven't had sleep over this, I just don't want my son and I to be separated from my husband if I get denied.
Have you heard any case like this? Is there a chance our case goes through and gets approved? Should we start getting a lawyer now?
Any advise or insight is much appreciated.
