  • I-485 RFE - What happens to original Receipt Date and processing time

    I had submitted my I-485 last year and got a receipt date of around Aug 8th 2007. Around December 2007 I received a RFE. I responded to the RFE immidiately and on January 3, 2008, USCIS received my response and the status showed "Response to request for evidence received, and case processing has resumed". The case status has a LUD Jan 18th 2008. I have already received my EAD and done with my finger printing.
    The case status also says "...You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done..."

    It's been more than 60 days now. The "Processing Time frame" in Texas Service center for I-485 shows April 10th 2007.

    1. Is getting an RFE good or bad ? Does it slow down the processing time?

    2. Does this mean my case is not being processed now ? Only when the Processing Time frame" crosses Jan 3 2008, will it resume processing ?

    3. Does geting an RFE voids the original receipt date ?

    4. Even though its more than 60 days, when I called up USCIS (at he given 1-800 number), the auotmated system gave me the same status (as shown on the website). Anyone knows why ?

    Appreciate any help, insight on this

    Read answers in bold:

    1. Is getting an RFE good or bad ? Does it slow down the processing time? It is bad. It slows the process.

    2. Does this mean my case is not being processed now ? Only when the Processing Time frame" crosses Jan 3 2008, will it resume processing ? It has resumed already, since you received the updated status.

That is just a standard message (the 60 day thing) do not pay attention to it. You did mail your application to the Chicago Lockbox right?

      So now the receipt date for my case Jan 3rd 2008. Is that right ?

      Also what does it mean by "case processing has resumed"? Does it mean USCIS is currently working on my case or it is simply in an active state ?

      What is meant by "you can use our processing dates to estimate when this case will be done"? Does this mean that when "Processing Time Frame" reaches Jan 3rd 2008, only after then I can expect things to start moving ?

      I guess I am just trying to find out as to when can I exepect to see some light at the end of the tunnel ....

        So now the receipt date for my case Jan 3rd 2008. Is that right ? Pretty much. Yes. ALL it really means is that you should "count" 60-90 days from that date to get your EAD/AP.

        Also what does it mean by "case processing has resumed"? Does it mean USCIS is currently working on my case or it is simply in an active state ? It means that the case processing continues, nothing more...

        What is meant by "you can use our processing dates to estimate when this case will be done"? Does this mean that when "Processing Time Frame" reaches Jan 3rd 2008, only after then I can expect things to start moving ? You are worrying too much. Most people who get RFEs (which is pretty much everyone... are slowed down 2-4 weeks, that is all.

        Just relax and be patient... that is the key
