I-485 was DENIED!!!

Dear ALL,

My marriage based adjustment of status was denied because we did not show up for the first wife&husband interview. BUT WE NEVER RECEIVED THE APPOINTMENT LETTER!!!!

What could/should we do?

When we go the USCIS office, could they arrest me and deport me because my case is denied????


SHOULD I TAKE A LAWYER????

You can file a motion to reopen or refile again along with a cover letter stating an explanation of what happened. You will not get deported as long as you refile again within 30 days from your denial notice. I'm sorry! I have heard so many people being denied due to letters lost in the mail.

Get a lawyer, file a motion to reopen the case or re-file it. Make sure they have your updated address and make sure your mailman knows you live there... put your name inside your mailbox.

I talked with a lawyer, who is in the family and she said we dont need to file for emotion at first, my wife and I should just visit the SF office and explain the situation and maybe the gonna give us an new appointment!

Is this so simple???? I am just scared to be detained.

Sorrry but one more question:

when I apply for emotion, do I have to apply for my work-autho.? or can I keep working and keep my valid one??

You do not need to apply for a new EAD unless yours is expired. Why don't you make an infopass? You will NOT get deported.

Relax, you do need to file a motion or refile as you are out of status......maybe with you so nervous you should also get a lawyer.

The same thing just happened to me.

We have never received any letter for the interview, and We got a letter now saying that we did not show up and the case is rejected.

Please tell us what have you done so far.

We have a lawyer now and she said it will be fine. She is asking now the local office to give us a new appointment. If they say NO, we have to refile to wohle package again, like I485 and all the other forms! Gonna cost us a lot of money and time. But you cant do nothing! Just wait and hope.

Find a good lawyer, but dont pay to much, cause it is a clean case and not a big issue. U are married to a us citizen.
