Can anyone help me with the AOS forms??

  • Can anyone help me with the AOS forms??

    I need help with the following:

    1. If he is not in the U.S and has a visa, is the best option for him is to apply for a fiance visa??? Can he even apply for one when we already got married?

    2. when they say to file the i-130 and i-485, does that mean i have to pay the 1,010 posted on uscis site plus additional fee of i-130(about $355more)??

    3. after filing i-485 is there any other fees that i may have to pay during the processing??

    Now i'm reading through everything--my other questions are:

    1.) Is it better for him to live with me for a couple of months and then ask for AOS?

    2.) On the form i-130 when it asks for Family name-- should i be putting my married last name?(his) or my last name before marrying him?

    3.) If he was to live with me and then i apply for i-485 and i-130 when asked for current uscis status on the 1-485, what do i enter?

    4.) On i-130 question #17 asks: List husband/wife and all children of your relative. Since we are now married should i put my name as his wife ?

    5.)oh and on i-485 part 2 should he put option a.an immigrant petiotion givingme an immediately available immigrant visa number has been approved???

    6.)now where do i get the i-94 # from??

    7.)on i-130 question #15 is that expiration of the b1/b2 visa??i need lots of help .. i'd appreciate if anyone responds back

    -algo guys i'm new here.. i wanted to ask when i post a thread and someone replies but then i have other questions do i post another thread?? or just post reply to my own thread??

He can not apply for a fiancee visa if you are already married. He will have to apply for a K-3 spousal visa or get an immigrant visa through Consular Processing. Unless the visa he has is an H1 or L1, he can not use it to enter the USA.

You do not need to worry about the i-485 yet, that is only for people who are in the USA right now and are filing for AOS. Since he is not in the USA (yet), you only need to start with I-130 ($355).

Just ask more questions... you really need to read the instructions and provide more background information. Where is he right now, when did you get married, etc.

            Well i married him on 3-3-08 and he doesn't live with me yet but i want him to.. i'm currently renting with a friend and i plan to live with him there. now i'm asking if it's better for him to live with me for 1-3 months before i even ask for him or is it better to just do the whole process through the consulate?

            --if he has b1/b2 visa can he stay with me prior to aos form?? any fees for staying with me?

            --now are you given a i-194 when u get b1/b2 visa?? how does he replace it if can not find it??

                well we decided that he will stay here with me, yes we´re in the U.S now for 2 weeks now and we got married here in texas... but i want to apply in may for the aos.. also we're in a border city and his b1/b2 visa says border crossing card also .. does that matter?
