  • Divorce 3weeks After Interview

I Am An American Citizen, And My Husband Is Who I Filed For. He Came Here Legally But Never Left. If I File For Divorce Prior To A Decision Being Made By The Uscis How Does That Look For Him. Would He Still Be Approved And Able To Rome The World As He Is Looking So Forward To Doing....or Would Uscis Take The Divorce Filing Into Consideration. Also Now That The Interview Is Done Its Basically All Over, Would I Still Be Able To Withdraw As His Petitioner/sponsor.

The I-864 Affidavit of support can not be withdrawn.

What was the outcome of the interview? was he approved? is it pending namecheck?

basically, the only way to "void" the Green Card would be if the divorce is finalized before the GC is approved.

At this point there is not much you can do. If he is approved already, but it is a conditional green card that he receives, he will have to file I-751 to remove conditions by himself with enough evidence that the marriage was entered in good faith, but since you are filing for divorce within 1 month of the card being approved. I doubt he will be able to get those conditions removed.

He may be able to live and roam free for 2 years, but after that... it is all over.

Again that all depends on the outcome of the interview. Please provide more information.
