AOS without I94

Hey folks, I am a Canadian resident, originally from the Philippines. I have applied for a tourist visa b1/b2 in Vancouver before crossing the US border in 1999. My uncle and I crossed the border around 530am and the border patrol agent didnt even bother to look at my passport with my visa and my uncles citizenship (canadian) card and just asked where we are headed. we told him i was being dropped off in blaine, WA station of greyhound coz im headed to LA, he asked if we are both citizens and my uncle said he is and i am a resident. Border agent then asked if how long will i be gone and i said probably a month or 2 and he let us through, didnt even get up from his chair. I have worked since 2000 in the US until now non stop and i just got married to a USC on Jan of 2008 (and yes its true love not fixed, lol). So now that Im about to sign up with a lawyer, I have been reading about aos and having the I94 which i dont have. Will i have a chance of adjusting status? since i dont have the I94, am i considered EWI?

For canadians, it is well known that an I-94 is not needed in all cases. Having a visa will help your case. But I do consider necessary you getting a good lawyer to help with the details. Also, stop working illegally until you get your EAD.

thanks praetorian. I agree that canadian citizens doesnt need to get I94. For canadian landed immigrants like me, i think we are required to get one but i didnt know at the time to ask for it nor the agent didnt even bother to ask for my passport since my uncle whos driving is handing it to him. I know i shouldnt work illegally but i have filed and been filing taxes since 99 hope i am helping the economy somehow...in the shadows tho...
