    well i filed for him, well he did all the paper work and i just signed my name and showed up at the interview. so yes it is family based he is my spouse and yes i am a usc. we have been married for 2 years 3 months. so if the divorce becomes final before the 2 years is up his gc will expire and then what...can he apply for an adjustment before it expires. knowing him know that it has been approved he's probably applying for an adjustment before the gc even comes in the mail. also i am 6 months pregnant, after i file for divorce i also plan on filing for full custody of my daughter...( who i am pregnant with), or as soon as shes born...does his status play a part in how the judge may treat the situation...meaning is there a chance i will be granted full custody because he is not yet a permanent resident.

    As you have been married for more than 2 years preceding the approval of green card, the GC that your husband gets will be free of conditions. Generally, if the marriage was less than 2 years, then the approved GC will be conditional.

    As far as the custody battle goes, if your husband has a GC, you will not have any additional advantage based on immigration status. Other factors will determine who gets custody like in a normal separation case.

      1485 aproved now what

      my husbands GC came in the mail today..we just had the interview on 3/25....that was fast. on the card it states it will expire 2018..in ten years. suppose i feel that he married me out of convienice to get what he need....can i express this to an uscis office(r).. and also prove that he is and has been living someplace else other than with me..what could possibly happen...will i be asked to have an interview, be taken to court?...what. and i know once i file for divorce he will not sign, he will object it and possibly tske me to court

        Unless you prove that you were forced to attend the interview on 3/25 against your will to USCIS and the marriage was not in good faith, he is free to have his GC.

        It does not seem so as you are pregnant and are going to have a baby. There is no point in trying to use that as the marriage seems to have been in good faith until recently.
