  • I-130....i-94? Help

    I was born in spain. when i was 5 my mom came to the US on a visitor visa with me and my older sister. we didnt have passports, we were under my mothers passport. i am 18 now, engaged and im looking at the I-130 form and its talking about the I-94 form. which i do not have...if i leave that blank, will they reject me? ANOTHER concern i have is going for the adjustment of status interview...will i be deported? im going to file them as soon as i get married which is...any day now. I also am confused on what forms to file....

    i have to file the I-130 WITH the G325A (for me & him) ...then what?

    You must prove that you entered legally to the country. Otherwise you can not adjust your status.

    Either a stamp on the passport or the i-94 or file an I-102 for a replacement for the I-94.

      thank you for replying about my I-94 situation. but when my older sister went to spain 5 years ago...she returned to visit. and they gave her a hard time because she was already in the US. and then she went back to spain & then she came back again and they gave her a hard time again. My question is, if they search my name, will they be able to see that i DID come to the US on a Visitors Visa and overstayed my visit? Because, if they know that my sister was here and went back to spain, they should also know that i came here on a visitors visa, right? im sorry, i just need help. and it will be great if u helped me. THANK YOU SO MUCH!
