  • My Status?, and Should I get another H1b

    Hi guys,

    Please take a minute for answering my concerns,
    ND: 3 Oct,01
    EAD: Dec,01
    FP 18, Jan(Phone message),
    my family and my H1 expired, end last month.

    - As I am in waiting period and to save money, I did not apply for new H1b. Does this mean that I am automatically on EAD now? I am not sure.

    - Can I get H1b again, thru a totally new company? How my GC would be affected with new company H1b? (I read in this forum that being on H1b retains status, in case GC is stuck).

    - Is CSC getting slow these days (its 7.5months since ND)? isnt it surprising?

    I am also under the same category as u. I have not applied new H1 and my H1 is going to expire in july 02. FP done in Marh 02 and waiting for Approval.. from Vermont..

      You'd better send an EAD copy to your HR incase INS will audit sometimes.

        make sure you are not out of status

        if your H-1B expires, you have to:
        (1) file for an extension to your H-1B
        (2) file for a new H-1B in case of new employer
        (3) file for EAD card

        you have to be under one of three categories above regardless of status of GC application.

        just make sure you are not out of status otherwise INS will give you problems later.

            EAD - having or using...?

            It depends - having an EAD and using the EAD makes a difference. If you knew your H1 was expiring, one should inform their HR to file form I-9(I guess) to avoid out of status. Consult your lawyer for appropriate advise. Good luck!
