I-485, I-131 & I-765 forms - what name to file?

Hi there,

If I'm filing forms: I-485, I-131 and I-765 - should I file those documents with my wife's maiden name or use the new last name which would be husband's last name if she will be using that eventually?

Also I'm confused which office to mail these documents - is it the chicago office or should I mail it to the Nebraska office since I reside in California?

Who is the US Citizen? if it is the husband, then the wife is taking the husband's last name and it must be legally changed on her documents to avoid problems before filing.

if it is the wife, and the husband is the alien, then she is taking his last name and she can have documents changed easily.

Either way, you may want new documents with new name before starting the whole thing. or you can just file with maiden name, it doesnt matter much at the end, just put the "married" last name in the I-485 name box.

thanks for the response. I'm the husband but it's unclear how I change her name. Since she is from outside of the US - all of her documents have her maiden name and now that we are applying for adjustment of status since we just got married - I'm confused if I should use her maiden name in the documents and then change her last name once I receive the documents or should I file them under using her married last name and then try to refer to her maiden name where possible on the forms.

You should file with the name that your wife wants it to be in all the documents. for the Other name used:..... (should should put her maiden name here). However, you need to have proofs of legally name changed like Marriage certificate. Good luck

mistake

Ive recently got married and i already start my process to change my status, but i've filed all my form using my last name instead of my husband's last name. Was that a mistake to use my last name instead of his? And when do i need to change my name on the social security or do they issue you a new social security number after my i-485 is approve?
