I would appreciate if you could point me in the right direction! Here is my history:
1. Came to US with a J-1 visa subject 2-year FRR in 1995.
2. I got married to a US citizen in 2000. I-130 was submitted and approved. (Submission date was grandfathered by LIFE act.)
3. My J-1 status ended in 2003. I was not able to renew my visa or get a waiver. So, I am AOS since then.
4. I had a short term employment in 2004.
5. I finally received 2-year FRR waiver. And, now I will apply for adjustment of status.
I am confused with I-485-A. Based on the facts above, do I need to file this form? In the form it says I don't need to if "You are applying to adjust status as the spouse or unmarried minor child of a U.S. citizen or the parent of a U.S. citizen child at least 21 years of age, and you were inspected and lawfully admitted to the United States."
I think, as a spouse of US citizen and being admitted to US on a J1 visa, I shouldn't need to. Any comments?
Will my unauthorized employment in 2004 be a reason for rejection? Or do you think LIFE act may protect me...
