  • moving from NY to NC while AOS is in process.

    When I filed AOS on 14th April-02 I was living in NY (VSC). Next month I have to move to North Carolina (TSC) as new project is there. Will this move effect the AOS process?

    are you switching employers or is this just a temporary assignment (like a consulting assignment)?

    i am also a consultant and if you are not switching employers and need to travel for a period of a month or two, then its okay.

    however, if you are moving permanently (even if with the same employer) you will probably need to file a new labor cert.

    you cannot switch employer unless >180 days after RD of AOS. you will be abandoning your current AOS in this case.

    you should clarify with your lawyer.

      Thanks for reply.

      I am moving to North Carolina because my current employer has a client there. I will be working/living there for at least 6 months.

      When I inform INS about change of address, which is mandatory, will they boot me to TSC.

        you should be fine

        since you are still employed by the same employer (not your client) you should be fine. consultants need to travel all the time- that's part of your job and you cannot be expected to keep filing new labor petitions in every state you go!

        anyway, this is just my opinion. check with a lawyer and make sure that by your physically living in NC it will not screw up your case.
