In California, am I eligible for Unemployment Insurance benefits if I get laid off after Fingerprinting and still waiting for I-485 approval and 180 days have not passed yet? I checked the official California EDD website and it says that you must have been on legal status while you were employed and must have legal employment authorization while claiming benefits. Since I have the EAD, I should be able to collect unemployment benefits.
Even if we are eligible, is it worth going for it since in order to get the GC, we are supposed to have employment? and if INS finds out that I got laid off, they may deny the I-485.
