  • Urgent, Plz Help! Thanks

    Dear All,

My case was denied, because we did not show up, but we did not receive the appointment letter!!

I hired a lawyer and my lawyer contacted the Local Office in SF, CA, but no respond received. Now she sent the 4th request for a new appointment!

The local office received 3 requests from our LAWYER for a new appointment, but they are just not responding to those requests.

CAN I STILL APPLY FOR A EXT. OF MY WORK-PERMIT???

    THANKS A LOT

    Hi,
why don't you just go onto the website USCIS and make an InfoPass appointment online and turn up at the office where your paperwork is?

If you received an actual notice of action telling you that the I-485 has been denied. Then, sending request for re-scheduling is not going to do any good, nor it will to show up for an infopass. It is denied and you can't "fix it" by just sending them a letter.

You will have to get a lawyer and file a MTR (Motion to re-open) the file. You should get a new lawyer, since the current one should have known this already and did not advise you this way.

On another note, you may not renew your EAD (work permit) since your I-485 is denied.

You can either file a MTR or re-apply the whole thing... it is up to you.

Time (MTR takes longer) vs Money (filing I-130 and I-485 all over again is more expensive)

Filing again for I-130 and I-485.

PS: stop typing in ALL CAPS.

Definitely. The medical results are valid for one year only. So if its been a year already you need to do it again.
