140 Approved & iam in current due to personal reasons iam not applying for 1485....

Hello Everyone,

My i140 is approved in feb'08 and i am in EB2 current since April 2008, due to personal reasons i want to apply i485 later,

i want to know...

i) is it ok if i dont apply for i485 for until a year.

ii) until what time i can Delay maximum.

Please help me out in this regard what are the concequences in delaying the Applying of I485.

1. It depends. Once your PD is current, USCIS will not extend or renew your H1b accourding to AC21 section 106. If you have an approved H1b past that date, you will be fine. Otherwise, without a 485, you will fall out of status.

Why don't you want to apply now since you have the chance to do it. Definitely this will raise questions with the USCIC. Whatever decision you make i hope you will make a wise decision.
