  • Moving to EAD, from H1b

    Hi (please help),
I am still waiting for my GC approval from CSC. FP was Jan18(on Phone message), and got me and my wife's EAD in Dec, but my H1b expired a week ago.

    Qs:
    - As per my lawyers i dont need to extend my H1b (and family H4), as I already have my EAD. Is this true? (i want make sure if our GC processing and status both goes ok)

    - should I benefit from EAD and transfer my status to EAD (while working with the same company)?

    - What is the procedure for transferring status to EAD?

    Thanks!

    Not Legal Advice:

Yes. But you must remember to renew your EAD on time to keep working legally.

    - should I benefit from EAD and transfer my status to EAD?

It does not make much difference except fo having to extend it annually instead of every three years.

    - What is the procedure for transferring status to EAD?

Fill out an I-9 using EAD and give it to your employer.

Note: If you wish to travel out of US you MUST obtain an Advanced Parole Document. Your Lawyer should have done this for you automatically but if not get one just in case (even if you never have to use it).
