  • I485 pending - JOb change

I got the EAD/AP in October 2007. H1b is valid till October 2008. Need to change the job. I think the job is of "same/similar" skills.

Once I resign and go to a different company:

    1. Do I need to notify USCIS? If yes then how?
    2. Does new employer need to do any paper work to bring me onboard as far as immigration is concerened?
    3. My and my wife's EAD is expiring in Oct 2008. Can we renew EAD ourselves or my new emplyoer neds to do that?
    4. My and my wife's AP is expiring in June 2009 (As per the I 94 date ). Can we renew AP ourselves or my new emplyoer neds to do that?
    4. Do I need an attorney to do all the renewals evey year or it's easy enough for me to do myself?
    5. How much does EAD and AP renewals cost?

    1. Yes. AC21 request to port your permanent employer to the new one. Though not mandatory, it is highly recommended.
    2. None. You may have to ensure the above and talk to your attorney about the AC21 portability and how it fits in just to be sure.
    3. EAD is YOURs. Employer has nothing to do with it. You can renew it yourself. Some employers pay for it and can have their legal department do it for you which you can check.
    4. Yes, see #3
    5. Check USCIS website. $340 and $310 a piece I guess.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.
