  • Could your I-485 be refused if????

    1. yuo could not provide enough evidence for Date of Birth. My wife does not have BC and since she was born after 1970 she cnnot get a non availibilty certificate.
    We have affidavidts from parents, Baptismal Certificate(she is a catholic), Birth certificate from Indian embassy in Chicago, and school and college leaving certificate. will this be enough or will our i-485 be denied.

    Any response will be greatly appreciated

    Hi,

    That's a hard one...I've noticed that the INS is getting a bit tougher on birth evidence.

    Before a case is denied, the INS will give you plenty of chance to explain your situation. First they will send you a "request for evidence" if the birth evidence you send is not enough. This request is just a letter explaining why the birth evidence is not enough. If you really, truly cannot find any sort of birth evidence, you can write back to the INS officer to explain this and ask what they would accept. They will write back to you before anything is denied.

    I would have to see your wife's document to determine if it is enough. The baptismal certificate sounds promising. I think she will be okay. Just send everything you can collect and keep trying in the meanwhile to get some sort of official certificate from back home.
