Hi. In one of the forms there's a question if the person who is applying for visa was working illegally. I've came to US on J-1 visa and I've overstayed it 2 years. I was working illegally but I've paid taxes. I still have papers certifying that I was working and paying tax. However... because I wasn't working on my original INS number I never did my taxes to get a taxback. My point is :

Does it count for them that I was working and PAYING taxes? Should i write that down or just leave the space blank ad write that I didn't work. Since I didn't do my taxes for the past two years ( I could have gotten some money back, but i didnt want to bring any attention to my person )

    Thank You kindly for advices.

You have to mention any work, even if illegal. What is the reason for AoS? Marriage?

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

You better make sure you were not subject to the 2 year home residency requirement.

          On my visa it says:

"Is not subject to section 212(e).
Two rear rule does not apply"

          So i guess Im ok.

You are safe on that side. But for the time being, you need to cease working until you get your EAD.

You are not authorized to work with an expired EAD nor just by filing paperwork. You need an approved EAD to be able to work.

File for EAD based on your AOS and wait until it is approved (60-90 days) and then you can work.
