    My I-140 approval notice says that , " ...petition has been approved. We have sent it to the Department of State National Visa Center (NVC),....."

    Does that mean it is going for consular processing?

    We had not choosen consular processing in I-140.

    All 140s go to NVC which generates A#. After your 485 app is received, the concerned SC will get your file from NVC.

      Talked to NVC. They informed me that only those cases that need consular processing go to NVC.

        Don't know the significance. However if you want you can change it to 485. Inform NVC and apply to the relevant SC if you want to pursue 485 instead of CP.

          YES it means your I140 was approved for consular processing. Depending on your case and your service center you might want to pursue CP instead of AOS. If you want AOS you will have to request that NVC return your file to your service center.

            No, The only why to start your green card process through consulate processing is to fill out the paperwork from the National Visa Center (which you will receive after your company gets the I-140 Approval Notice), and your lawyer would file a I-864. Changing your process from adjustment of status to Consular processing.

            If you do not respond to the National Visa Center then you I-140 just sits there. If you feel more comfortable getting your I-140 case to your INS Service Center. Then have your attorney write a letter to the National Visa Center stating you are filing your green card through adjustment of status. Also include a copy of the letter from the National Visa Center, Copy of your I-140 Approval Notice, and Copy of I-485 Receipt Notice (if you have already received it). What happens next is you will receive a letter from the National Visa Center stating they have sent your I-140 to your INS Service Center.

            Even if you chose not to go this route, it will not hurt your I-485 case if it is there. I have had an employee I-485 case approved, even though his I-140 was at the National Visa Center. Also I have talked to an officer at the National Visa Center and she said that this is two different things.
