My attorney advised me to withdraw the I-485 application to adjust status since we filed the I-751. Here is the full story:
I am a US citizen and my wife came here on k1-visa, when her 2 year conditional green card was about to expire we filed the I-485 along with I-864 and I-751, since I am currently unemployed I cheked unemployed on the I-485, two weeks later I received the notice of receipt and an RFE stating that I need to provide paychecks stubs and a letter from my employer (which I can not provide since I am unemployed). I consulted an attorney and he advised me to just withdraw the I-485 period and it is not necessary to file it since I have the I-751 pending. If the attorney is correct, then why do people file the I-485 and the USCIS is taking almost $1000 from me and other people? Do you have to file I-485 to adjust status or I-751 is enough?
Any help is very much appreciated, the clock is thicking on the the RFE.
