  • Travel on a pending I-485 approval and expired K1 visa?

    Can my wife travel within the US on her foreign passport with a expired K1 visa while we are waiting for a I-485 approval?

    The passport is valid but the I-94 and K1 visa have expired but we are waiting for the I-485 to be approved. We did receive a notice of receiving the doucments but nothing else. Please advise.

    No. She can not.

    Even if her visa was still valid, leaving before an I-485 is approved is considering by USCIS as abandoning her application. Therefore it would be denied.

    She can only travel using an Advance Parole (I-131) document ONLY ONCE IT HAS BEEN APPROVED.

      I guess I'm confused. Are you saying that she can't travel from one state to another state while she is waiting for an approval on her I-485 and advance parole. What is she able to do then until she get a travel document. I thought that the advance parole document is for traveling outside the US.

        I jumped the gun! sorry.

        All she needs for travel WITHIN the USA is a government issued ID (if she will travel by plane) and her I-485 receipt notice.

          what would be considering government issued since she doesn't have a drivers license as I need a social security number and she doesn't have a SS# since we didn't apply in time before her I-94 expired. So I only have her foreign passport with a expired K1 as the US visa.

            i did not say US government issued ID. I said government issued ID... that means her passport.
