    You will be out of status in all situations unless he is on H1b and should either find a way to switch to another status of your own than be his dependent as you are separated and don't even have a pending 485 which would make you out of status even if your husband uses EAD or parole.

        What if your husband has already got his GC or using his EAD or Parole? How will you change status? You would need H1b proof like paystubs etc to change status from H4 to any other status. In your best interest, you should not overstay as COS or anything to do with visa is difficult without such proof about valid stay.

          It could be as early as the start of August if the PD is current and it could get delayed upto 180 days after which USCIS has agreed to issue GC even if it is in security checks.

          Like I said earlier, if you need to change status for yourself, you would need proof that your husband is in status (like his paystubs, H1b approval etc)

          You need to find a way to maintain your own status ASAP!

            Concern in getting GC

            Folks,

            I have a question here. In fact, I am in EB2 category and the priority date shows 2006 (some month), as USCIS updated. Earlier to this, it was 2004 (some month). I don't understand why I am not getting my GC where my POD is May 2001. What should I do? Will I request my attorney to send some queries to USCIS about my case? Like Mr. "txh1b" mentioned... if the PD is current and it could get delayed upto 180 days after which USCIS has agreed to issue GC even if it is in security checks. Should I call up USCIS Service center? Advise me please...
