  • How to replace a lawyer?

    I changed jobs after 180 days of filing for the I-485.
    I have searched and scanned various discussion boards to find out the exact steps to replace the previous employer's lawyer but could not find detailed informatio . My questions are:
    1. How do I notify INS that I want to replace previous company hired attorney and appoint a new attorney to represent my case?
    2. If I decide not to hire a new attorney, do I have to file a G-28 form to inform INS that I am going to represent myself?
    3. How do I notify TSC of change of address? Is it mandatory to file form AR-11 for address change? (The address on the form is INS DC office.)

    How to replace a lawyer?

    Not Legal Advice:

    1 - Do you have the receipt no for your case. If so give it to your new lawyer. If he is any good he should know wahat to do and how to file a new notice of apearence. In the i-485 stage you the INS will correspond with you directly (or at least send you copies of the correspondence) since you (not the company) are the applicant now.

    2 - I don't know. But you should get an attorney.

    3 - You send them a letter which is clearly marked CHANGE OF ADDRESS on the envelope. Inside it you should have a letter which states your receipt No. (The SRC No), Your name, Your Old address and your new address. Send it return receipt (so they have to sign for it). If they have assigned an A No to you you should also send the AR-11 form as well (to the address marked on that). Send that with a return receipt as well.

    It is mandatory to notify the INS of a change of address and lately they have been getting a lot fussier about minor stuff like that. Whether they are competent enough to update their files is another matter entirely so make sure you keep the Return Receipts from the letter. It is even better to do it through your attorney so there is at least one other person (besides your self) who can verify that you made every attempt to comply with the law.
