  • How do I find out my current USCIS Status?

    Hey Everyone,

Just found this forum and I have a question!

How do I find out my current USCIS Status? I am trying to fill out my I-485, I-765, I-131 & I-865 but they need my status which I'm not sure of!

I came to the US on a B2 6 month Visa, got married before my visa expiration date and then filed an I-130 which has been approved. The office said these forms were my next step.

Has anyone else filed these forms recently and know how I go about finding out my status? I'm been in the US for a year and a half now, my I-130 was approved a few months ago.

    Thanks!

    You are out of status.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

Thanks, does this mean I should leave this blank on the form? I know they say if you leave anything unanswered it deems it incomplete and is denied.

You need to write out of status.

BEWARE. You have been out of status for a very long time and you probably have earned a 10 year bar from entering the USA if you leave before your GC is approved.

So forget about filing for I-131, do not even bother about it... even if it is approved, you can not used it to safely return to the USA.

Wait until you have your GC approved and in your hands before you leave the country.

              Thanks PraetorianXI,

That is a good thing to know! I won't be filing the I-131 now, I am going to file everything else associated with the I-485 and wait until it's approved before I go anywhere!

              Thanks again
