  • Adjustment of Status and I-94

    I am a US citizen and applied for I-130 petition and I-485 adjustment of status for mother who entered US on visitors visa. We got the receipts for both I-130 and I-485, she also got her fingerprints taken in 3-4 weeks after the application. The case is in processing and her I-94 visitor visa expires next week. Do I need to take any action to extend her I-94? Is I-94 relavant any more?

    Thanks in advance for your help.

    No need to worry about the date on the I-94 anymore. Her legal status is now "pending AOS (i-485) adjustee". Which means she is allowed to stay until a decision is made in her case.

        I got a question..Pls. while traveling on AP do I have to hand out my I-94 at the border on my way out?

          Yes. You will get a new I-94 upon re-entry.
