  • I-485 and H1-B

    Hi,

My H1-B expires on Aug 17th 2008 and my EAD expires Aug 29th 2008.
I have applied for my EAD renewal on June 7th 2008, completed my fingerprinting and waiting for my EAD card.

I have my I-94 until May 2009 based on my Advance Parole return to US. Am i still required to apply for my H1-B extension, will it be a problem in case i do not get my EAD before Aug 29th, 2008. Please Advise ?

    Thanks

You are a parolee now and you need EAD to continue working legally. If you want to switch back to H1b status, you need to apply for renewal. You need either a H1b renewal or EAD to work past 8/29.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

I have a question. In case i get my EAD, i work on my EAD and do not extend my H1-B and due to some reasons if my I-485 gets rejected, will we be deported out of the country or can we re-apply for I-485 ? Are we going to be Out-Of status at that point ?
