  • Change of Job after 180 Days & legal Requirements

    Can somebody share experience as regards any legal requirements if one changes the job after 180 days.

    Do I need to inform INS or if not then if any RFE comes then does it have any impact becz of change of job . My new company will not sponsor the GC.

    If INS asks for somethings like Financial statements of the co. then do I have to show statements of the co. which sponsored my visa or the new co.

    Anyone in immihelp topic monitoring team/ viewers, please tell what to do or there is anything to be concerned abt.

    When you change job under this rule, your new company has to provide documents like employment letter etc (that way, indirectly they are sponsoring your GC.) If new company can't give any document, you can't continue GC process.

    When you change job under this rule, you are transfering the GC process from old to new company, and you can not pursue it independently.

      helpful hint

      Here's a helpful hint for people using the 180-day rule: be sure to keep in touch with your old lawyer, even if your new company sets you up with a new lawyer. Most mail (like requests for evidence - very important!) will still go to your old attorney.

      Some lawyers are idiots and figure that once the client goes to the new attorney, their job is done. Then they don't follow up, and something gets missed. I've seen it before.

      Don't call and bug your old attorney every day, but also don't ask them to shut your file. Don't move or change phone numbers (work or home!) without telling them.

      If your new company does not give you an attorney, your old attorney should still keep working with you. In 99% of cases, his or her fees have already been paid. So s/he's obligated to see the case through to the end. Don't feel bad about asking their continued help.
